1. Access & Acceptable Use

By accessing diglino.com or any subdomain, you agree to these terms. Access is granted on a temporary basis for informational and business purposes. We reserve the right to withdraw or amend access without notice.

You are responsible for ensuring that all persons who access the site through your internet connection are aware of these terms and comply with them.

Prohibited Conduct

  • Violating any applicable laws or regulations.
  • Transmitting unauthorized data or malware.
  • Attempting to gain unauthorized access to systems.
  • Using the site for commercial solicitation without consent.

2. Intellectual Property & Content

All content, features, and functionality on this site—including but not limited to source code, designs, text, graphics, logos, and images—are the exclusive property of Diglino Studio or its licensors and are protected by international copyright, trademark, and intellectual property laws.

Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

3. Limitations of Liability

The following trade-offs define the boundaries of our responsibility. We are transparent about what we can and cannot guarantee.

Trade-off: Availability vs. Maintenance
Downside: Service may be temporarily unavailable for maintenance or technical updates. Mitigation: We schedule critical maintenance during low-traffic periods and post notices in advance when possible.
Trade-off: Third-Party Integrations
Downside: Functionality relying on external services (e.g., payment gateways, analytics) may fail independently of Diglino. Mitigation: We select reputable partners and implement graceful degradation where feasible.
Trade-off: Data Interpretation
Downside: Information is provided "as-is" and may become outdated or contain errors. Mitigation: Users are advised to verify critical information directly with Diglino Studio before making business decisions.

4. Common Questions from Clients & Partners

Anticipating these questions reflects our operational clarity and commitment to partnership.

What happens to my project data if I terminate service?

You retain ownership of all provided assets. We will provide all deliverables in agreed formats and delete source files from our active servers within 30 days of contract end, unless a separate archival agreement exists.

Do you work under NDA?

Yes, standard NDAs are accepted. We cannot sign overly restrictive agreements that conflict with our right to show our role in finished work (e.g., in a portfolio) unless under strict confidentiality.

Who owns the final codebase?

Upon full payment, you own the executable code and assets we build for you. Our underlying frameworks and libraries remain our intellectual property unless purchased separately.

What is your liability for third-party services?

We are not liable for the performance or security of third-party APIs, SDKs, or hosting services you or we select, though we exercise due diligence in our recommendations.

How are scope changes managed?

All changes to scope require a written change order, which may impact timeline and cost. Verbal requests are not considered binding.

What if the project is abandoned by either party?

In the event of mutual termination, you pay for all work completed to date. We transfer all relevant assets and documentation for an extended handoff fee.

5. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.
